1. DEFINITIONS
1.1. “SAKEwinkel” is an online marketplace owned and operated by B4iProductions Proprietary Limited with registration number 2021/933972/07, acompany duly incorporated under the laws of the Republic of South Africa,facilitating the purchase of products between the Subscriber and the Provider;
1.2. “Subscriber” means the person who subscribed to the SAKEwinkel toobtain access to the Products and/or Tickets as facilitated through SAKEwinkel;
1.3. “Supplier” means the entity from which wine is purchased by theSubscriber;
1.4. “WYNROETESwyne” means the online portal situated on the SAKEwinkelplatform operating as a redirection service to an independent third-partySupplier.
2. TERMS AND CONDITIONS
2.1. The WYNROETESwyne portal on the SAKEwinkel platform functionssolely as a redirection service to an independent third-party Supplier. Byselecting and using the WYNROETESwyne option, the Subscriber acknowledges andagrees that they will be redirected to the Supplier website (www.getwine.co.za)to complete any wine purchases or related transactions.
2.2. All transactions conducted via the Supplier website aregoverned exclusively by such Supplier’s own terms and conditions, including itsprivacy policies, delivery terms, refund and return policies, and any otherapplicable provisions. Subscribers are strongly advised to review andfamiliarise themselves with the Suppliers policies before proceeding with anypurchase.
2.3. Any and all enquiries, complaints, claims, or supportrequests relating to purchases made through the Supplier must be directed to theSupplier. SAKEwinkel does not manage, support, or process transactions made viathe Supplier platform.
2.4. The Subscriber understands and agrees that SAKEwinkel doesnot guarantee the availability, pricing, or quality of any product sold by theSupplier.
2.5. Any enquiries, disputes, or requests for support relating to theprocurement of any wines must be directed to the Supplier, and not toSAKEwinkel.
3. DISCLAIMER OF LIABILITY
3.1. SAKEwinkel shall not, under any circumstances, be held liablefor any transaction, claim, loss, damage, delivery issue, product qualityconcern, non-performance, or other matter arising from or related to the use ofthe Supplier’s website, or any third-party services accessed via the WYNROETESwyneportal.
3.2. All purchases made through the Supplier are conducted solelyat the Subscriber’s own risk. SAKEwinkel shall not assume any responsibilitywhatsoever, for the fulfilment, shipment, condition, accuracy of productdescriptions, or any terms governing the sale of wines or related goods andservices offered by the Supplier or its affiliates.
